The Wellness Lab · Federal hemp action

CONGRESS IS BANNING YOUR HEMP PRODUCTS.IT'S NOT JUST YOUR DRINKS.CAPS DON'T WORK. BANS DON'T WORK.REPEAL SECTION 781. PROTECT THE WHOLE PLANT.

The new federal definition of hemp threatens much more than drinks. We're asking Congress to repeal Section 781 and build a fair, enforceable framework that protects consumers and independent businesses.

The law, not the rumor

The deadline: December 11, 2026.

Section 781 became law in November 2025. A September 2026 law delayed most of its new hemp restrictions until December 11, 2026—it did not repeal them. Some restrictions involving cannabinoids not naturally produced by the plant already apply. Read the extension (opens in a new tab)

When fully applicable, the law changes the hemp test to 0.3% total THC (including THCA) and excludes final hemp-derived cannabinoid products containing more than 0.4 mg per retail container of combined total THC and certain other cannabinoids with similar effects. “Container” means the innermost retail package—not a serving. Other exclusions also apply, including to certain synthesized cannabinoids. Read Section 781 (opens in a new tab)

The law does not ban every hemp product. It expressly retains an industrial-hemp category for stalk/fiber and non-cannabinoid seed and grain uses. A non-intoxicating label alone does not decide whether a cannabinoid product qualifies; its composition and the law's other exclusions matter.

Proposal versus law: H.R. 6209, the American Hemp Protection Act of 2025, proposes repealing Section 781. It was introduced and referred to the House Agriculture Committee; it is not enacted law. Read the introduced bill (opens in a new tab)

More than one product aisle.

Depending on ingredients and testing, the new definition could affect:

  • THC beverages
  • Gummies & edibles
  • Tinctures & oils
  • Hemp-derived flower
  • Certain topicals & other cannabinoid products

This is a description of statutory risk, not a claim that every item in these categories is prohibited today.

What is at stake

REAL PEOPLE. REAL JOBS. REAL BUSINESSES.

These figures are industry economic estimates, not government-certified sales totals or losses already sustained. They help show the scale of farmers, processors, manufacturers, distributors, retailers, and employees who could be affected.

$38.7BEstimated 2026 U.S. hemp-cannabinoid total addressable market—potential market demand, not recorded sales. 2026 report (opens in a new tab)
350KEstimated U.S. jobs supported by the hemp-cannabinoid sector in Whitney Economics' September 2026 analysis. This is not a count of layoffs. See the estimate (opens in a new tab)

Whitney Economics also models possible future revenue and job losses if strict rules fully take effect; those are projections, not outcomes. Florida establishment counts and Florida-specific employment estimates vary by license type and methodology, so we are not presenting an unverified single count as fact. Our position

REAL SAFETY. NOT PROHIBITION.

We support meaningful consumer protections: age verification, independent product testing, accurate labels, transparent potency disclosures, appropriate packaging, and accountability for unsafe products.

We oppose blanket prohibitions and arbitrary THC-per-container caps. Our advocacy position is that rigid caps are not a substitute for evidence-based regulation and may move consumers toward less accountable markets. This is an argument for thoughtful policy, not a proven prediction about every market.

YOUR VOICE MATTERS. CONTACT CONGRESS.

Your federal voice matters most here.

Section 781 is federal law. Contact both Florida U.S. senators and your own U.S. House representative. Use your street address to find the right House district; we do not assume every visitor lives in the same one.

Florida state lawmakers

Florida state senators and representatives do not vote on Section 781, but they shape state policy. The Florida Senate's address lookup can identify your state lawmakers and congressional district.

Officeholders and contact forms were checked October 20, 2026. Verify your district before sending.
